By accessing and using the Savvy Hire Studio website at www.savvyhirestudio.com, you are accepting and consenting to the practices in these terms of use. Savvy Hire Studio reserves the right to change these terms and conditions from time to time at its sole discretion. 

Through the Services, we aim to give you access to beautiful designer clothing, stylist advice and other content to help you decide which items are perfect for you. LEGALLY BINDING Contract.

 

Definitions

In these Terms of Use “you”, “your”, "client" and "borrower"  refer to all users of this Website and "Savvy Hire Studio" (“we’, “us” and “our”) refers to Savvy Hire Studio. References to users must be read as being also a reference to customers of www.savvyhirestudio.com. Under no circumstances is the Client able to allow other individuals to wear the Garment in the Rental Period, unless permission is granted from Savvy Hire Studio first. Under no circumstances is the Client allowed to wear garments outside their home or to an event of any kind (including at their home) if hired as a "try on" at "try on" prices.

  • "Account" means the bank account nominated on your Direct Debit Request (if any).
  • "Agreement" means these direct debit service terms and Direct Debit Request.
  • "Banking Day" means a day other than a Saturday, Sunday or public holiday listed throughout Australia.
  • "Card" means the credit card nominated on the Direct Debit Request (if any).
  • "Financial Institution" means the financial institution where you hold the Card or Account from which you have authorised us to debit payments.
  • "Garment" means any and all clothing supplied on hire by Savvy Hire Studio to the Client (and where the context so permits shall include any incidental supply of services). The Garment shall be as described on any invoices or other documentation provided by Savvy Hire Studio to the User.
  • "Hire Terms and Conditions" means the hire Terms and Conditions between Us and you in relation to the provision of the Services.
  • "Interstate" defines any Garment that is rented outside of New South Wales.
  • "Price" means the fees and charges payable by you to Us for the Services as set out in the Hire Terms and Conditions, and includes late fees and fees (at the recommended retail price) to replace any fashion apparel lost, destroyed or ruined by you.
  • "Rental Period" refers to the agreed and booked 4-day period of time that the Garment is being hired by the Client for the "Rental Price" ("price") - starting from the day the Garment is picked up from our premises or dispatched to the User’s delivery address, to the day the Garment is supposed to be dropped in mail by the User or returned to our premises, as shown on Savvy Hire Studio’s website.
  • "Rental Post Return Date" means the date the Garment is to be lodged at an Australia Post Office.
  • "Rental Return Due Date" defines the date the Garment is to be returned to Savvy Hire Studio's premises.
  • "RRP" means the Recommended Retail Price of the Garment as determined by Savvy Hire Studio acting reasonably​.
  • “Savvy Hire Studio” (‘Us’, ‘Our’ or ‘we’) means Savvy Hire Studio. ‘you’ or ‘your’ means the customer who signed the Direct Debit Request.
  • "Services" means the Savvy Hire Studio website located at www.savvyhirestudio.com (the “Site”) and related services including Savvy Hire Studio’s fashion rental services and its content (the “Content”).
  • “User” (“client”, “customer”, “you” or “your”) means the User or any person acting on behalf of and with the authority of the User.

 

LEGALLY BINDING Contract

These Terms of Use constitute a binding legal contract between you and Savvy Hire Studio. These Terms of Use apply to you whether you are browsing or are a customer of Savvy Hire Studio. The Terms of Use in force at any time are published on the Website and you will be taken to have accepted them by accessing or using the Website.

If Savvy Hire Studio develops revised terms of use then on their publication on the Website they will supersede those they replace. If you subsequently access or use the Website you will be taken to have accepted the revised terms of use. If you do not agree with the terms of use application from time to time, do not access, use, submit information to or download from this Website.

These Terms of Use may change without notice, so do check from time to time. If you do not agree to any change, you should terminate the use of the Website. Specific Website offerings, incentives, areas, or section may also have additional guidelines which govern your use of this Website. You must comply with them in addition to these Terms of Use. This agreement contains all of the terms and conditions regarding your rental of products from Savvy Hire Studio via the website www.savvyhirestudio.com.

You agree that rental from our business is subject to all our website terms and conditions of use and privacy policy. These are available on our website and are subject to change from time to time.

You agree that you are renting products, and ownership of the product remains with Savvy Hire Studio at all times. Our products may be rented for customers who are under the age of 18 however we only rent directly to adults who may rent the products on behalf of a minor. By clicking “I accept” rental agreement button you represent that you are over 18 years and are authorised to use the chosen method of payment with the purpose of renting the products on the order. Savvy Hire Studio reserves the right to cancel any bookings at our sole discretion, refund will be provided and reasoning does not need to be given.

  

Our Commitment to you

We will deliver the product that you have ordered including the correct size, colour, and style on or before the date you have specified for delivery on your order. Except where we have indicated to you that your request for this is not possible or guaranteed and therefore your order has been amended. Products may appear different in colour and style then the images listed on the website. Our liability to you for failure to deliver a product you have ordered is limited only to timely delivery.

 

Payment Terms

The Price shall be Savvy Hire Studio’s current Price, at the date of delivery of the Garment, according to Savvy Hire Studio’s current Price list as detailed on Savvy Hire Studio’s website.

Savvy Hire Studio reserves the right to change the Price in the event of a variation to the User’s requirements. At Savvy Hire Studio’s sole discretion a deposit may be required. At Savvy Hire Studio’s sole discretion a bond may be required which shall be refunded upon return of the Garment in a condition acceptable to Savvy Hire Studio. 

The "hire fee" for the garments is included in the price and includes professional cleaning and any additional charges listed on the website in relation to your hire of products. The “hire fee” does not include postage, postage is an additional charge added at checkout if postage is the distribution method chosen by the client. When you hire a garment, you authorise Savvy Hire Studio to charge your payment method for the stated price (including the hire fee). In addition to your hire order for a product, you authorize Savvy Hire Studio to charge your payment method up to an amount to 200% of the entire original retail value of the product as set in the “Recommended Retail Price”, or “retail value” on the website. Provided we only charge your payment method when you have not upheld your commitment to us as set forth in the hire agreement below. In the event an invoice is issued for payment for any reason then payment shall be due within seven (7) days of the date of the invoice.

We may ask for photo ID, credit card details or other forms of identification. We can refuse the right to hire if you are unable to provide the requested identification or document(s). If we have requested this information it is your responsibility to provide this information immediately. In the event we are unable to fulfil your hire or delivery on time due to the information not being provided a credit only will be applied, no refunds will be given.

** PLEASE NOTE: YOUR ORDER WILL NOT BE DESPATCHED UNTIL FULL PAYMENT IS RECEIVED. If you are paying using PayPal please do not use eCheque. We only receive notification of your order when payment is received in full thereby using eCheque your order may not be processed before your hire date. If you use eCheque and your order is not received in time you will receive a credit note for the full amount paid.*

 

Sizing Issues/Faulty Garment

If a product doesn’t fit you or is not right for any reason you must email support@savvyhirestudio.com within 24 hours of delivery. Then post your hire back within 24 hours of delivery and we will issue a credit note once the dress is returned to us in its original condition. The term “unworn” will be determined by Savvy Hire Studio and must be fulfilled prior to a credit being issued. You must inspect your dress, notify us and send through photos of any damage within 4 hours of delivery of the garment, you may be responsible for the damage if we are not notified within this time period or sent photo evidence of the damage. If returning via post, we highly recommend posting at a post office where the parcel is scanned. If the dress arrives back to us late and you are unable to provide proof it was posted within the 24 hours of delivery then you will not be entitled to a refund/credit note.

 

Shipping Details

All parcels are marked authority to leave. If you require your parcel to be signed for you must specify this in the delivery instructions at check out.

We use Express shipping on all orders at a flat rate of $22 return for orders Aus wide. **PLEASE NOTE: This rate only covers items sent in the same order. If you are booking more than one dress and they are for different weekends you must place your bookings separately and pay the shipping amount separately in each order. Your delivery can be delivered to you between 7:00am and 8:00pm on the requested day of delivery or earlier. Your hire period starts from the time the courier attempted first delivery and credits will not be issued for late delivery where you have not been available to accept delivery. When placing an order you automatically give us authority to leave your parcel in a safe place. If you do not wish to grant us this authority you must clearly outline this in the delivery instructions at checkout. You understand and agree that this authority to leave gives us and/or our selected couriers permission to leave the Order in question unattended by the front door, in the letterbox – or, where applicable, at the reception or concierge’s desk – of the delivery address without obtaining a signature confirming delivery at the delivery location. In such circumstances, you understand and agree that by granting us authority to leave, we and our couriers are released of all responsibility and liability for the Orders delivered and left unattended, and that this responsibility and liability transfer to you on delivery.

We do not take responsibility for orders where an incorrect/ineligible address has been provided. If you have supplied an incorrect address you will not be entitled to a refund of any kind and you may be liable to pay any late fees or a replacement fee if the dress is not returned to us. In the instance where a parcel is unable to be delivered in time due to AusPost being unable to gain access and/or leave the parcel in a safe place and you have not provided delivery instructions you will not be entitled to a refund of any kind and you may be liable to pay any late fees or a replacement fee if the dress is not returned to us. If you have supplied an address that has a redirection service set up and your parcel is not delivered in time you will not be entitled to a refund. Once the parcel has been despatched if you redirect it in anyway you will not be entitled to a refund if it does not arrive by the chosen delivery date. Redirecting a parcel will increase the delivery time by approximately 2-5 business days. By choosing signature on delivery you are accepting that anyone on that premises can sign for your parcel, once the item is signed for responsibility and liability transfer to you.

We aim to deliver hires as early as possible to mitigate any postage delays. Your delivery may occur up to ten (10) days prior to your chosen delivery date. Please ensure you provide a permanent address where there will be somewhere safe to leave a parcel or someone to accept the parcel up to 10 days prior to your chosen delivery date.

In the rare occasion that the dress is delivered after your return date you are still required to return the dress as soon as possible (no later than 48 hours after delivery). If you require additional time to return the dress due to a late delivery please contact support@savvyhirestudio.com. If a dress is not returned you are liable for 200% of the RRP of the dress, you may also be liable for late fees if you do not return the garment within a reasonable timeframe. It is therefore required that you select a permanent address that someone will be available at in the unlikelihood of the dress not being delivered as per your chosen date. 

Please note we aim to deliver every item as quickly as possible. If you order in advance and the dress does not arrive to you in time you will be entitled to a full refund. Any last minute hires (orders placed less than 36 hours before being despatched) that do not arrive in time will be entitled to a credit note only and not a refund.

Orders placed after 2pm AEST will be shipped the following day. No refunds will be given for orders placed after this time that do not get delivered by the following business day.

 

Pick Ups

Pick up/Drop off address will be provided in the Order Confirmation, and will be placed in the letterbox at 2pm on the pick up date. Alternate times can be arranged via email support@savvyhirestudio.com.

Bookings online for pickups must be placed a minimum of 48 hours before hire date. If your event is less than 48 hours we ask that you message us via Instagram @savvyhirestudio, Facebook https://www.facebook.com/savvyhirestudio/, or email support@savvyhirestudio.com before placing your booking so we can confirm the dress is available.

 

Returns (Postage)

With delivery of your product, pre-paid return packaging is provided. Please ensure that you place your dress inside the provided box and self-addressed satchel (as you were given in), stick the return label over the original label, and drop it at your nearest Post Office or YELLOW Express Postal Box by 4pm on the last day of your hire. If you are planning on returning your dress from a different postcode to the delivery address on your order than you must contact support@savvyhirestudio.com prior to hiring. Savvy Hire Studio will not take responsibility for lost item(s) returned in Australia Post Boxes. If you lose your return packaging it is your responsibility to safely return the garment via trackable express post to Savvy Hire Studio, address provided upon request. You must provide tracking details and photo of addressed satchel to support@savvyhirestudio.com in order to avoid further borrowing charges. Items damaged in this process due to lost packaging may also incur further borrowing fees.

If you return your item(s) via an Australia Post Outlet (highly recommended) where it will be scanned over the counter as proof of lodgement then the article will be deemed as returned and we will accept responsibility for the article after the first scan. If you return your item(s) via an Australia Post Box and the item(s) is not scanned and is lost by Australia Post then you accept responsibility for this loss and will be required to pay the retail cost of the item(s) in addition to the hire fee already paid.

Please note we remove the tracking sticker from the satchel so we can track the parcel coming back to us. If you wish to track yourself please make a note of the tracking number on your satchel and you can track this via Australia Post's website. In addition if you lodge your counter over the counter at a post office they will issue you a receipt with the tracking number on it. 

If your hire period ends on a Sunday or public holiday Simply slip your dress in the return satchel provided and return to the nearest YELLOW Express Postal Box on the return date. Otherwise, you can always return across the counter at the Post Office the next business day.

 

Returns (Drop-Off)

If you are hiring through the pick up/drop off method, please ensure that you place your dress inside the provided bag/box (as you were given it) and return to the same address you picked it up from. Place the bag/box inside the letter box of the pick up/drop off address (provided on the Order Confirmation) by 2pm on the last day of your hire, otherwise late fees apply.

If you lose your return packaging it is your responsibility to return the garment in safe packaging to ensure the garment does not get damaged in the return process. Items damaged in this process due to lost packaging may incur further borrowing fees. 

 

Cleaning

Professional cleaning is included in your hire and you agree that no attempts will be made to clean, alter, iron/press garment/s (unless otherwise arranged). All garments are professional steamed prior to sending however can become creased in the post. Certain fabrics are more prone to wrinkles though, and if you receive a dress with slight creases, please try steaming the garment on low heat. Alternatively, you can hang the dress in a steamy bathroom and the steam will de-crease it. If you need further assistance please email support@savvyhirestudio.com.

Savvy Hire Studio shall not be held liable for any health-related complaints associated with a product rented from our site. Our products have been worn by other consumers prior to your rental.

  

Damaged/Soiled/Replacement Garment

You agree to treat our products like you would your own. You will treat the garment with the upmost of care.

We offer free damage insurance to the value of thirty dollars ($30) to cover minor damage. For minor damage if Savvy Hire Studio assesses (at its sole discretion) that the cost of repairs will be over thirty dollars ($30), then you will be required to pay the difference (e.g. if the repair cost is fifty dollars ($50), then Savvy Hire Studio will require you to pay twenty dollars ($20). If Savvy Hire Studio assesses (as its sole discretion) that the dress is not repairable, you will be charged the full replacement value of the dress; as per the amount on our website. Dresses deemed irreparable are not covered by the $30 insurance.

 

Late Fee Policy 

You agree to return your product on the order return date (or next business day if your return date falls on a Sunday or public holiday) by 4pm using the prepaid return box and satchel provided. If you return your item(s) late you will incur a thirty dollar ($30.00) late fee for every day you are late up to 200% of the retail value of the dress as indicated on our website. You agree to pay these late fees up to an amount not exceeding 200% of the retail value of the products. If you have not returned your product within 20 days of the return date your product will be considered a non-return and you will be charged 200% of the retail value of the item(s). If you lose your packaging it is your responsibility to return the items(s) to Savvy Hire Studio within one (1) business day of return date, in safe packaging. You must purchase return shipping at your own expense and provide the tracking number to Savvy Hire Studio. Savvy Hire Studio will not be held liable for products which are late, damaged or lost in transit due to your chosen method of shipping.

If you return your item(s) via an Australia Post Outlet (highly recommended) where it will be scanned over the counter as proof of lodgement then you will not be responsible for late fees provided the item(s) are lodged by 4pm on your return date (or next business day if your return date falls on a Sunday or public holiday). If you post your item(s) via an Australia post box you will be charged $30 each day the dress is received after one (1) business day of your return date.

  

Collection

If you do not pay the amounts owed to us when due we will pass on the invoices to a collection company to pursue you for collections, including and without limitation attorney and collection fees. Savvy Hire Studio reserves the right to terminate your right to rent products from us at any time at our own discretion should you breach this agreement or for any other reason.

 

Title To Hired Apparel

The Apparel is and will at all times remain the absolute property of Savvy Hire Studio. If the User fails to return the Apparel to Savvy Hire Studio then Savvy Hire Studio or Savvy Hire Studio’s agent may (as the invitee of the User) enter upon and into land and premises owned, occupied or used by the User, or any premises where the Apparel is situated and take possession of the Apparel.

 

Cancellation Policy 

Unfortunately we do not provide refunds for cancellations as the garments has therefore been unavailable for other customers to book. Full store credits are provided if the cancellation is over 14 days prior to the hire date. Email support@savvyhirestudio.com to cancel your booking.

COVID-19: The above cancellation policy applies to all orders cancelled due to COVID-19.

 

Use of Savvy Hire Studio Products.

You agree to treat our products like you would your own. You will treat the garment with the utmost of care. You will not attempt to fit into a dress that is too small for you, you will not try and zip up a dress that is too tight and therefore damage the zip. All zips are inspected prior to sending the garment out and damaged zips will not be covered by our insurance. Therefore, if you damage a zip you will be required to pay for the repair.

  

Credit Notes/Gift Cards

One credit note only can be applied per order. Credit notes/gift cards do not have an expiry and are valid on HIRE items only (NOT clearance stock). Orders placed using credit notes are final and cannot be refunded or exchanged for another credit note.

 

Email

We will use the information from your order to send you email marketing on occasion. We don’t however pass on any of your detail including your email address to any other companies or corporations. You may opt out of receiving those emails by emailing support@savvyhirestudio.com.
